1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering, you represent that you meet this requirement and that the information you provide is accurate and complete.
2. Account Registration
You may browse the Site without an account, but creating one is required for certain features (order history, saved addresses, faster checkout). You are responsible for keeping your login credentials confidential and for all activity on your account. Notify us immediately at [email protected] if you suspect unauthorized access.
3. Products and Availability
We sell live houseplants and related goods. Because plants are living and unique, the actual plant you receive may vary in size, shape, leaf count, and color from the photographs displayed. We reserve the right to substitute a plant of equal or greater value when the exact item shown is unavailable; we will notify you before shipping if a substitution is significant.
All listings are offers to sell, not binding offers. We may decline or cancel any order at our discretion, including for reasons of inventory error, suspected fraud, or shipping restrictions.
4. Pricing, Taxes, and Payment
Prices are listed in U.S. dollars and exclude applicable sales tax and shipping. Sales tax is calculated at checkout based on your shipping address and current California tax law. We make every effort to display accurate pricing; if a pricing error occurs, we may cancel the affected order and issue a full refund.
Payment is due in full at the time of order. We accept the payment methods listed at checkout. By submitting payment information, you authorize us (or our payment processor) to charge the total amount.
5. Shipping and Delivery (Live Plants)
We ship within the United States only. Estimated transit times are provided at checkout but are not guaranteed. We are not responsible for carrier delays.
Live plants are perishable and sensitive to temperature, light, and handling. We pack each shipment to reduce transit stress, but minor cosmetic damage (yellowed or dropped leaves, soil shifting) is normal and not covered by replacement. We do not ship live plants on weekends or before holidays where the parcel could be held in transit longer than 72 hours.
You are responsible for being available to receive the package and for moving it indoors promptly upon delivery. Damage caused by leaving plants exposed to extreme temperatures after delivery is not covered.
6. Returns, Refunds, and Damage Claims
Our return and refund policy is described in detail on our Refund and Returns Policy page and is incorporated into these Terms by reference. In short: we will replace or refund any plant that arrives in unacceptable condition if you contact us with photos within 48 hours of delivery.
7. Plant Care Disclaimer
Care guides and recommendations on the Site are general information, not professional horticultural advice. Plant health depends on many factors outside our control (your climate, light, watering, pests, soil, pets). We are not responsible for the health or longevity of plants after delivery.
Some plants we sell are toxic if ingested by humans or pets. You are responsible for reviewing product descriptions and keeping plants away from children and animals as appropriate.
8. Intellectual Property
All content on the Site – text, photographs, logos, graphics, and code – is owned by houseplants or our licensors and is protected by copyright and trademark law. You may not copy, reproduce, or republish any content without our prior written permission, except for personal, non-commercial use.
9. User Conduct
You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to any portion of the Site, accounts, or systems; (c) interfere with the Site’s operation through scraping, denial-of-service activity, or automated tools beyond reasonable browsing; (d) submit false, misleading, or abusive content (including reviews) or impersonate another person.
10. Reviews and User Submissions
If you submit a product review, comment, or other content, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, display, and reproduce that content in connection with the Site and our marketing. You represent that the content is your own and does not infringe on anyone else’s rights.
11. Disclaimers
The Site and all products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
12. Limitation of Liability
To the maximum extent permitted by law, houseplants, its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of your use of the Site or any product, even if advised of the possibility of such damages. Our total liability for any claim related to the Site or a product will not exceed the amount you paid for the product giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless houseplants and its affiliates from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any third-party right.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
15. Privacy
Our handling of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
16. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Site after changes are posted means you accept the updated Terms.
